Article 269
Formation, registration and operation of political parties
:(1) Persons committed to the same political ideology, philosophy and program to form and operate a political party subject to the law made under clause (c) of sub-section (2) of Article 17 and the ideology of the party, In order to get the support and cooperation of the public towards the philosophy and program, they can promote and spread it, conduct it or do other necessary work for that purpose.
(2) The political party formed according to sub-section (1) shall register the party with the Election Commission after completing the procedure according to the law. (3) In addition to the constitution and manifesto of the relevant political party, when submitting an application for the purpose of registering a party in accordance with sub-section (2), other documents as per the federal law shall be submitted.
(4) When submitting an application for party registration according to sub-section (2), the political party must fulfill the following conditions:-
(a) Constitution and rules of political parties should be democratic (b) In the constitution of a political party, there should be a provision for the election of every official of the party at the federal and provincial level at least once in five years, but if special circumstances arise and the election of the official cannot be completed within five years, such an election can be held within six months. (c) There should be arrangements for inclusive representation in the executive committee at various levels of the party to reflect the diversity of Nepal.
(5) If the name, purpose, symbol or flag of a political party is of a nature to disturb the religious or communal unity of the country or to divide the country, such political party shall not be registered.
